Extract from Nic Burns email to D. Rothwell and V. Byrne, 2nd August 2011
Gen. 7 and 6.
" G) On 17/18 Jan l792, a Deed of Lease and Release by made by Charles Byrne of Sleaty, Gent. to William Finn of Carlow Town, a farmer, (probably a relative of his aunt Ann Finn) was recorded in the Registry of Deeds (449-169-287729). In this record, the deed in A) above is recited, and it further states that both the Charles Byrne of Sleaty, and his son Gerald Byrne of Sleaty mentioned in that 1736 deed are now "both since deceased", and that the land was now in possession of a Charles Byrne of Sleaty. The transaction was witnessed by James Byrne of Carlow Town (who I believe to be a lawyer and one of the Leighlinbridge, Carlow Byrne's, who I believe are ancestors of Richard Francis Mcdermott Byrneand not related to the Sleaty Byrne) and also witnessed by Mary Byrne of Sleaty (possibly and probably Mary Kavanagh Byrne the wife of Gerald Byrne and the mother of the Charles Byrne the second, who now possesses Sleaty). It appears from this last document, G) above, that Charles Byrne, the second, was very possibly a late born child of Gerald Byrne and Mary Kavanagh, when Gerald was about 66 years old !!! It appears to me that Gerald Byrne, was fully aware of the requirement of his father, Charles the first's will, realized that if by the time the will was to be probated and settled, that if he did not produce a male heir, that Sleaty would revert to his aunt Ann Best and her heirs.
So the question is: Were Gerald Byrne and Mary Kavanagh married in c1736 as offered by Daniel below, or were Gerald Byrne and Mary Kavanagh married late in Gerald's life, c.177 1, for the purpose of retaining inheritance rights to the Sleaty property?
NOTE: In the ancestry message boards, at the link below, is an interesting mention of a Gerald Byrne and Mary Kananagh marriage in 1771, one year before the date that Val has, in his family records, the birth date of Charles Byrne the second. I think we need to examine this marriage 1771 record, mentioned below, as well as the 1736 marriage record that Daniel mentioned. httns://mail .irelandcom/zimhraIh/messae?si=3&so=0&sc=1 02579&sfi=2&st=rnessa. . 02/08/2011 ___________________________________________________________________________________________________
I understand that no documentation on the purported 1736 marriage was forthcoming from D. Rothwell. Val Byrne ___________________________________________________________________________________________________
